What are the fence requirements, and who do I need to check with before putting in a fence?

Standard yard fences can be placed up to the property line, but not over.  Make sure an updated survey is in place that has clearly marked the property lines.  The type and style of fence allowed is regulated by the North Oaks Homeowners association. All fence requests must be submitted for approval through the nohoa@nohoa.org website. (This is a separate entity from the City.)  To avoid neighborly disputes, we strongly recommend you talk with your neighbors to alert of your fence plans and share the survey with property lines. Vegetation/trees may have overgrown which may lead to confusion on where the lines are.

You do not need to apply for a standard yard fence permit through the City, only the Homeowners association. They can be reached at 651-792-7765 with any questions.

POOL FENCES are regulated through the City of North Oaks: Per City Ordinance155.055 Swimming Pools and Spas: all pools MUST have a 5 foot pool safety fence in place, with self latching gates.  View the full pool fence ordinance requirements. This is a standard part of all new pool permit process.  A pool fence escrow form will need to be completed, an escrow check submitted to the City before the building permit can be released. This escrow check will be cashed, and refunded once the pool passes final inspection and the required 5 foot fence is up.  Either the homeowner or contractor can submit these 2 items – it just needs to be received by City before permit can be released. Contact the City with questions on pool fences.

**  NOTE: The City does not come onsite to address property line disputes. Both parties will need to work with a surveyor.  Contact the City office  at 651-792-7750 if you would like to see if there is an existing survey on file for your property.
